Protect Your Trade Secrets

A trade secret is a special type of intellectual property right that can also be protected and even sold or licensed.

It is any information that gives someone a commercial competitive advantage, precisely because of the fact that this information is a secret for others.

Therefore, any information that has:
⨀ commercial value due to secrecy for others,

⨀ it is available only to a limited circle of people – it’s secret,

⨀ that the owner of the information has taken reasonable measures to preserve confidentiality (for example, a confidentiality agreement for business partners and employees).

The most common groups of data that represent a trade secret are:
FORMULA (key ingredients of the product);
PROCESS (cooking process with unique flavors);
METHODS (calculations or algorithms that improve decisions, operations);
TOOLS (proprietary design tools that improve quality and productivity);
PATTERNS (reusable solutions leading to multiple designs and processes);
AUTOMATION (systems that automate work to improve quality and efficiency);
EVERYTHING ELSE – (for example lists of suppliers and clients).
The unauthorized acquisition, use or disclosure of such confidential information by others in a manner contrary to fair trade practice is considered an unfair trade and business practice and a violation of trade secret protection.
Trade secrets include both technical information, such as manufacturing process data, pharmaceutical trial data, computer program designs and drawings, and commercial information, such as distribution methods, supplier and client lists, and advertising strategies. A trade secret can also consist of a combination of elements, each of which is in the public domain on its own, but where the combination, which is kept secret, provides a competitive advantage. Other examples of information that can be protected as a trade secret include financial information, formulas and recipes, and source code.
